The B-BBEE Affidavit: How Small Businesses Get a Free Level 1, 2 or 4
Somewhere along the line, ‘B-BBEE certificate’ became a thing small businesses believed they had to buy. For most, that is simply wrong. If your annual turnover is R10 million or less, the B-BBEE affidavit route gives you a recognised level — Level 4 at minimum, Level 1 or 2 with black ownership — for the cost of a sworn signature. Here is who qualifies, what the document must contain, and the mistakes that get affidavits thrown out of tender packs.

What a B-BBEE affidavit is — and what it is worth
The B-BBEE codes exempt the smallest businesses from verification entirely. An Exempted Micro Enterprise (EME) — annual turnover of R10 million or less — proves its status by a sworn affidavit instead of a certificate from a verification agency. The affidavit states your turnover band, your black ownership percentage, and the level that produces: Level 4 for a white-owned EME, Level 2 at 51% or more black ownership, and Level 1 at 100% black ownership. QSEs (R10–50 million) that are 51%+ black-owned may use the same route.
A Level 1 affidavit is commercially powerful — it gives your customers 135% procurement recognition on what they spend with you, which is why small black-owned suppliers are actively sought out. Who may use a B-BBEE affidavit (the R10 million line)
The test is turnover, measured on your latest financials or a reasonable estimate for a new business. Up to R10 million: affidavit, always. R10–50 million: affidavit only if 51% or more black-owned, otherwise a QSE verification certificate. Above R50 million: full verification. Startups in their first year may use an affidavit based on expected turnover. Getting the turnover test wrong — claiming EME status at R12 million — is fronting territory, and fronting is a criminal offence under the B-BBEE Act with penalties up to 10 years.
An affidavit is valid for 12 months from the date it is sworn. Diarise the renewal with your other annual filings — an expired affidavit in a tender pack is treated as no affidavit at all.
Getting your B-BBEE affidavit right: the details that get rejected
Procurement officers reject affidavits for boring, avoidable reasons: the wrong template (use the current Department of Trade, Industry and Competition format), missing enterprise details, no commissioner of oaths stamp, ownership percentages that do not add to 100%, or a sworn date older than 12 months. Sign in front of a commissioner — any police station, bank or attorney offers this free — and keep the original safe while you send copies.
