Ask anyone who has scrambled 48 hours before a tender closing date: the tender compliance documents South Africa‘s government departments and corporates demand are always the same six, and at least one of them is always expired. This guide lists each document, where it comes from, what it costs you in time and money, and how to keep the whole pack current so the next RFQ finds you ready instead of panicking.

Why every tender asks for the same six documents

Buyers — especially organs of state — carry legal duties of their own. They may only contract with suppliers who are tax compliant, registered on the Central Supplier Database, covered for workplace injuries, and (for state contracts) compliant with Employment Equity and minimum-wage law. The six documents below are simply their proof of those facts.

The trap is that each document is issued by a different authority with its own validity period and its own queue. Collecting them is a once-off project; keeping them valid is a routine. Most disqualified bids fail on an expired or missing document, not on price.

Sector tenders add their own layers on top of the six: construction tenders usually require CIDB grading, security tenders PSIRA registration, and transport or food tenders their own permits. Those are industry extras — the six in this guide are the foundation that almost every RFQ, vendor application and corporate supplier onboarding form in South Africa starts with.

1. COIDA Letter of Good Standing

The Letter of Good Standing (LOGS) is the Compensation Fund’s confirmation that your COIDA registration is active and your Return of Earnings and assessment payments are up to date. It proves your employees are covered for occupational injuries — and it is requested by name in most construction, maintenance and services tenders.

You generate it yourself on ROE Online once your account is compliant. If the system blocks you, the usual causes are an outstanding Return of Earnings, an unpaid assessment, or an audit query that needs payroll records or your EMP501. If you employ through a labour broker or use contractors on site, check whose Letter of Good Standing the tender wants — yours, theirs, or both. Principal contractors are regularly required to hold current letters for every subcontractor on the project, and an expired subcontractor letter has sunk many otherwise winning bids.

2. SARS Tax Compliance Status (TCS) PIN

The Tax Compliance Status PIN replaced the old paper tax clearance certificate. You activate TCS on eFiling and SARS issues a PIN; the buyer enters the PIN on SARS’s system and sees a live ‘compliant / non-compliant’ result covering your registrations, returns and debt.

Non-compliance almost always means an outstanding return or an unpaid debt. Fix the return first, then arrange the debt — and note a SARS payment arrangement only restores compliance once SARS confirms it on the system. A sworn B-BBEE affidavit must be signed before a Commissioner of Oaths (any police station or attorney) and remains valid for 12 months from the date it is sworn. Make three certified copies while you are there — buyers often want a certified copy rather than a scan, and the queue is not one you want to join twice.

3. B-BBEE affidavit or certificate

Buyers score suppliers on B-BBEE. What you provide depends on turnover: EMEs (under R10 million/year) use a simple sworn affidavit — Level 4 automatically, or Level 1–2 if 100%/51%+ black-owned. QSEs (R10m–R50m) can also use an affidavit if 51%+ black-owned; otherwise a verified scorecard. Generics (over R50m) need full verification through a SANAS-accredited agency.

4. Central Supplier Database (CSD) registration

Any business supplying an organ of state must be registered on the National Treasury’s Central Supplier Database. Registration is free and online; the system cross-checks your tax status, bank account and CIPC record automatically. You then download the CSD registration report that goes into the tender document.

Timing matters here: the certificate is valid for 12 months, and the Department assesses against your most recent EE submission. If your certificate expired mid-tender-season you cannot ‘extend’ it — you apply again, and any gap in compliance (an unfiled EEA2, an NMW finding) surfaces immediately. Treat it as an annual task on your compliance calendar, not a tender-time emergency.

5. Employment Equity Compliance Certificate (state contracts)

Since the Employment Equity Amendment Act took effect on 1 January 2025, employers who want to contract with the state need an EE Compliance Certificate under section 53 of the EEA. The Department of Employment and Labour issues it if you comply with the NMW, have no recent adverse CCMA or court findings, and — if you are a designated employer (50+ employees) — have submitted your EE reports and are moving toward the 2025–2030 sector targets.

6. CIPC company documents and good standing

Buyers verify that your company exists and is active: registration certificate (CoR14.3), Memorandum of Incorporation, director details, and — increasingly — proof that your CIPC annual returns and beneficial ownership filings are current. A company in ‘deregistration process’ is effectively disqualified until reinstated.
