Crossed 20 Employees? You Now Need a Health and Safety Representative

⚡ Quick answer
Once you employ more than 20 people, the OHS Act requires a designated health and safety representative: at least one per 100 employees in shops and offices, one per 50 in all other workplaces. The appointment must be in writing, for a defined area and period, made in consultation with employees — and the rep is entitled to training and reasonable paid time off to perform the role. Designate two or more reps and a health and safety committee becomes mandatory, meeting at least every three months with minutes kept.

Growth changes your legal duties quietly — and one of the quietest thresholds is twenty-one. The day you employ your 21st person, the health and safety representative obligation switches on under the OHS Act. Most employers discover it in an inspection. Here is what to do instead.

📌 Key takeaways
  • More than 20 employees = mandatory safety representative.
  • Ratios: 1 per 100 (shops/offices), 1 per 50 (other workplaces).
  • Appointments in writing, in consultation, with training and time off.
  • Two or more reps = a committee meeting at least quarterly.

The 20-employee trigger and the ratios

Sections 17 and 18 of the OHS Act make safety representatives mandatory for every employer with more than 20 employees. The minimum numbers: one representative per 100 employees in shops and offices, and one per 50 in all other workplaces — factories, sites, farms, warehouses. The designation is in writing, for a defined section of the workplace and a defined period, and made in consultation with employees or their union — not simply announced.

Choose the right person: someone the floor trusts, who notices things, and who actually wants the role. A conscript files nothing; a volunteer becomes your early-warning system.

What the health and safety representative does — and what you owe them

  • Inspects the workplace periodically and after incidents.
  • Identifies hazards and brings them to you with recommendations.
  • Handles employee safety complaints — the formal first channel.
  • Participates in incident investigations, including with inspectors.
  • Attends committee meetings where a committee exists.

Your side of the deal is equally specific: reasonable paid time off to perform the functions, and the training the role requires. An appointment letter without time and training is decoration — in an inspection, it is also evidence against you. The full mechanics are in the representatives and committees guide.

From rep to committee — and into the safety system

Designate two or more representatives and the next duty follows automatically: a health and safety committee, meeting at least every three months, with minutes kept. The committee is where rep findings, incident reviews and improvements get tabled and tracked — dormant committees (no meetings, no minutes) read as a dormant safety culture when it matters most.

The rep structure plugs into the rest of the OHS system: their findings feed your risk assessment reviews, their presence strengthens your position in incident investigations, and the whole framework sits in the OHS pillar guide. For a growing business, it is the cheapest safety infrastructure available — it costs time, not money.

Frequently asked questions

At how many employees must I appoint a safety representative?

More than 20. The minimum is one representative per 100 employees in shops and offices, and one per 50 in all other workplaces — designated in writing, in consultation with employees.

Do safety representatives get paid time off?

Yes — they are entitled to perform their functions during working hours with reasonable time off, and to receive the training the role requires. Denying either undermines the appointment.

When is a health and safety committee required?

When two or more representatives are designated. The committee must meet at least every three months and keep minutes.
