Growth changes your legal duties quietly β and one of the quietest thresholds is twenty-one. The day you employ your 21st person, the health and safety representative obligation switches on under the OHS Act. Most employers discover it in an inspection. Here is what to do instead.

The designation is in writing, for a defined section of the workplace and a defined period, and made in consultation with employees or their union β not simply announced.

Choose the right person: someone the floor trusts, who notices things, and who actually wants the role. A conscript files nothing; a volunteer becomes your early-warning system.
What the health and safety representative does β and what you owe them
- Inspects the workplace periodically and after incidents.
- Identifies hazards and brings them to you with recommendations.
- Handles employee safety complaints β the formal first channel.
- Participates in incident investigations, including with inspectors.
- Attends committee meetings where a committee exists.
Your side of the deal is equally specific: reasonable paid time off to perform the functions, and the training the role requires. Designate two or more representatives and the next duty follows automatically: a health and safety committee, meeting at least every three months, with minutes kept.
