Who qualifies for family responsibility leave

Section 27 of the BCEA grants family responsibility leave to an employee who (a) has been employed by you for longer than four months, and (b) works at least four days a week. Part-timers below the four-day threshold are excluded from this specific entitlement β€” though nothing stops you from extending the benefit by policy.

The entitlement is three days of paid leave per annual leave cycle β€” the same 12-month cycle used for annual leave. It is a single annual pool: three days in total, no matter how many qualifying events happen in the year.

The three events it covers

  • When the employee’s child is born β€” note that fathers and non-birth parents now also have 10 days’ parental leave; family responsibility leave for a birth typically serves adoptive or other circumstances not covered by parental leave, or tops it up by policy.
  • When the employee’s child is sick β€” ‘child’ includes adopted children. The Act does not set an age limit in so many words, but the purpose is care of a dependent child; employees with adult children should be assessed case by case.
  • On the death of the employee’s spouse or life partner, parent, adoptive parent, grandparent, child, adopted child, grandchild, or sibling.

Proof you may require

You may require reasonable proof of the event before paying the leave: a birth certificate or clinic record for a birth, a medical practitioner’s note for a sick child, a death certificate or funeral notice for a death. Apply the requirement consistently β€” demanding proof only from certain employees invites a discrimination complaint.

Proof can follow the absence if the event was sudden (a death or emergency hospitalisation cannot be pre-certified). Set the expectation in your leave policy: notify as soon as possible, proof within a reasonable time after returning.

Pay, carry-over and administration

Family responsibility leave is paid at the employee’s normal wage for ordinary hours. Unused days expire at the end of the cycle β€” they do not accumulate and are never paid out on termination.
